What is Canada Citizenship?
As for Canada, Section 3 and 4 of the Citizenship Act describes the requirements of a Canadian citizen. The section also draws a fine line between a Canadian citizen and a non-citizen.
In a broad view, a person will be tagged as a Canadian citizen in the following cases,
- He was born in Canada.
- Section 3 (2) describes the citizenship laws of a child to an accredited foreign-born in Canada. As per this subsection, the baby doesn’t get Canadian citizenship by birth. He would receive citizenship if his other parent was a permanent resident or a Canadian citizen when he was born.
- A Canadian parent adopted him outside Canada on and after January 1, 1947.
- He becomes a Canadian citizen through the naturalization process. Naturalization is the legal way for a non-citizen to acquire citizenship or nationality of a country. To qualify as a citizen, he must first be a permanent resident.
- A first generation born outside Canada also qualifies as a Canadian citizen. (i.e., he was born outside Canada. But one of his biological or legal parents was a citizen of Canada. Citizenship by birth or naturalization process before he was born is accepted.)
- The second or subsequent generations born outside Canada also get Canadian citizenship. (i.e., he was born outside Canada from January 1, 1947, to and including April 16, 2009. One of his parents must be Canadian and was born to a Canadian parent outside this country.)
